General Terms and Conditions

1. General

1.1 These general terms and conditions apply to all offers, orders and agreements from Machinefabriek Harderwijk bv, located at Zeppelinstraat 1.

1.2 By placing an order you agree to these terms and conditions.

2. Offer and Agreement

2.1 All offers on the website are without obligation and while supplies last.

2.2 An agreement is concluded when an order confirmation is sent to the customer by e-mail.

2.3 Machinefabriek Harderwijk bv reserves the right to refuse orders or attach special conditions to delivery.

3. Prices and Payment

3.1 All prices stated are exclusive of VAT, unless stated otherwise.

3.2 The first order is paid in advance. A payment term will be agreed upon for the next order.

3.3 In the event of non-payment by the customer, Machinefabriek Harderwijk bv has the right to terminate the agreement with immediate effect or to suspend (further) delivery. Goods remain the property of Machinefabriek Harderwijk until full payment has been made.

4. Delivery

4.1 Delivery takes place at the delivery address specified by the customer. 

4.2 Machinefabriek Harderwijk bv strives to deliver the order within the stated delivery time, but cannot be held liable for any delays.

4.3 Ownership of delivered products is transferred to the customer after full payment of the order.

4.Customers can pick up products at Machinefabriek Harderwijk at Zeppelinstraat 1 3846CL Harderwijk.  Machinefabriek Harderwijk is not responsible for packaging and transport when collection takes place.

5. Returns and Right of Withdrawal

5.1 Returns are only possible with a stated reason and in consultation with Machinefabriek Harderwijk. the packaging of products that are returned must be of the same quality as that with which they were sent by Machinefabriek Harderwijk bv. Damaged products will not be taken back or repair costs will be charged.

5.2 The costs of return shipment are borne by the customer, unless otherwise agreed.

5.3 Returns are not possible for custom-made or sawn products.

6. Liability

6.1 Machinefabriek Harderwijk bv is not liable for damage caused by incorrect use of the delivered products.

6.2 The liability of Machinefabriek Harderwijk bv is in any case limited to the amount of the purchase.

7. Force majeure

7.1 In the event of force majeure, Machinefabriek Harderwijk bv has the right to suspend the execution of the agreement or to terminate the agreement, without any obligation to pay compensation.

8. Intellectual Property

8.1 All intellectual property rights relating to the products and the website belong to Machinefabriek Harderwijk bv.

8.2 Without written permission from Machinefabriek Harderwijk bv, the customer is not permitted to copy, modify or distribute the products or content of the website.

9. Governing Law and Disputes

9.1 All legal relationships to which Machinefabriek Harderwijk bv is a party are exclusively governed by Dutch law.

9.2 Disputes between Machinefabriek Harderwijk bv and the customer will be submitted to the competent court in the district where Machinefabriek Harderwijk bv is located.
